Mediation
Mediation is a process in which a neutral third
party, the mediator, assists in the resolution of a dispute between two
or more persons. The use of the mediation process has increased significantly
in recent years as an alternative to litigation. In the typical mediation
session, the mediator actively participates with the parties in discussing
the issues to be resolved, helps the parties focus on these issues, and
offers settlement options for consideration by the parties. The goal of
mediation is to assist the parties to reach a mutually acceptable settlement
of their dispute.
Spouses may choose mediation as a means of resolving
all of the issues arising out of the termination of their marriage without
having to litigate these issues in court. Issues concerning custody, visitation,
child support, property division, and alimony can all be discussed at
length. A negotiated settlement of these issues can be reached and a written
settlement agreement prepared which incorporates the substance of the
agreements reached by the parties on these issues. Some of the advantages
of mediation are that it is a private process, it eliminates the stress
that results from contested court litigation, and it substantially reduces
the cost of obtaining a divorce. Mediation is now being used extensively
by the courts in Maryland after a divorce suit has been filed as a means
to help resolve the issues in divorce cases. Before a case proceeds to
trial, these issues are referred to a mediator to see if a negotiated
settlement can be reached.
I have had extensive training and experience as
a mediator and have handled many mediation matters. I periodically serve
as a mediator with respect to financial issues in divorce cases that are
referred to me by the Circuit Court for Prince George’s County Maryland.
